Please read these Terms and the Privacy Policy carefully because they govern your use of this website and my services.

These Terms are a contract between you and Evangelina D’Art. (“AgapeArt LLC”, “my” and/or “me”).


1. Agreement to Terms


By using this website and my services, you agree to be bound by these Terms. If you are using my services through this website on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind that company or other legal entity to these Terms. In that case, “you” and “your” will refer to that company or other legal entity.


2. Privacy Policy


Please refer to my Privacy Policy for information on how I collect, use, and disclose information from my customers and website visitors/subscribers. You acknowledge and agree that your use of this website and my services is subject to my Privacy Policy.

Protecting your privacy is really important to AgapeArt LLC. (“AgapeArt LLC”, “we”, “our” and/or “us”). With this in mind, I am providing this Privacy Policy to explain my practices regarding the collection, use, and disclosure of information that AgapeArt LLC receives through this website, as defined in my Terms.

4. ORDERS SPECIFICATIONS


When placing a custom order, please specify the date on which delivery and receipt of the item are expected.


Because of the nature of these items, AgapeArt cannot accept returns for custom or personalized orders.

Made To Order / Custom sized items require a minimum of 30% deposit before the creative process starts. The payment represents a percentage of the full purchase price. If a customized order is completed and ready for delivery and the purchaser will not proceed with the payment for it within 5 business days (unless stated otherwise), the down payment is not refundable and the product / service will not be provided.


For made to order/custom sized items that include personalized messages, spellings must be checked before being sent as AgapeArt will not be liable for the mistakes.

All items that have undergone a successful invoice transaction are considered final, paid, sold, and not refundable.

When the order has been shipped out, it is deemed final and complete.

A change of mind in the buyer’s part does not entitle his/her a refund.


Unless stated otherwise, all fees will be in U.S. Dollars.

I may, in my sole discretion and at any time, change my prices. If I do so you will be notified by email or before any changes are made. If you have a current agreement with me, your fees won’t change.


2. TAXES, PRICING AND SALES SPECIFICATIONS


Listed prices DO NOT include sales tax, transaction fees and shipping costs. For any changes required for a custom order after its completion, extra charges will be applied and you will be responsible for all applicable taxes.


AgapeArt has the right to refuse sale to any person who does not follow the terms and conditions. The price of any order shall be the price AgapeArt (Artist Evangelina D'Art) quoted or, where no price has been quoted (or a quote price is no longer valid), the price publicly listed on the website current at the date that AgapeArt accepted your order.

For the avoidance of doubt, the date that your order was accepted shall be the date that the item is marked as sold.


4.3 Promotions; Coupon Codes; Other Discounts


I may from time to time offer promotions, coupons, or other discounts. Coupon codes have no cash value, are not retroactive, are non-transferable and expire within 30 days of issue.


4.4 Chargebacks


If for any reason you contact your bank or credit card company to decline, chargeback, or otherwise dispute or reverse the charge of any fees in order to cancel your order without contacting me about it first, I may challenge your dispute and stop the creative process.


4.5 Payment Processing

Payment processing services for buyers are provided by PayPal and are subject to the PayPal Account Agreement, which includes the PayPal Terms of Service (collectively, the “PayPal Services Agreement”). By agreeing to this agreement / these terms you agree to be bound by the PayPal Services Agreement, as the same may be modified by PayPal from time to time. As a condition of AgapeArt, enabling payment processing services through PayPal, you agree to provide AgapeArt accurate and complete information about you and your business, and you authorize AgapeArt to share it and transaction information related to your use of the payment processing services provided by PayPal.

1.7. Once payment has been settled, AgapeArt will send you received payment confirmation and the order will be shipped within the next working day.

1.7.1. AgapeArt is not liable for any delays caused by unforeseeable

events, for damages or late deliveries caused by the 3rd party

courier.

1.7.2. Lost or damaged packages will undergo investigation with the 3rd party courier.

1.8. Payments must be made within 5 working days to avoid order cancellation.

1.9. Upon usage of the website, it is deemed that buyer has understood and read AgapeArt's terms and conditions.
